PRIVACY STATEMENT PURSUANT TO ARTICLE 13 OF LEGISLATIVE DECREE NO. 196/2003
 
Pursuant to art. 13 of Legislative Decree no. 196 of 30/6/2003 ("Privacy Code"), Caffè Haiti Roma S.r.L. advises that your personal details will be treated in compliance with the above-mentioned law and according to the following criteria:
 
1) Purpose of gathering the information: your personal details will be gathered, treated and kept for the following purposes:
- creation of a consumer database;
- prize contests;
- market and marketing surveys (subject to consent);
- data processing for statistic purposes (subject to consent);
- dispatch of information and advertising materials about Caffé Haiti Roma products, dispatch of newsletters, other promotional and commercial advertisement initiatives, also by e-mail or mobile telephones via Mms (Multimedia Messaging Service) or Sms (Short Message Service) (subject to consent);
- opening of contractual and commercial relationships;
- any other purpose for which the owner of the details have expressly provided his/her consent.
 
2) Form of processing and keeping of the information: the information will be processed with the tools and in the manner considered adequate to protect the security and confidentiality of the personal details, either manually or with the help of electronic or automated systems. The processing will include all the operations provided for by the law as necessary, including disclosure to the entities mentioned in item 4) below. Certain details may be processed by means of protected online networks and the Internet. In this case, the processing will be subject to the security standards offered by the net. The information will be processed by Caffè Haiti Roma employees and/or employees of leasing third-party companies contracted by Caffè Haiti Roma as the entity authorised to process and keep the information, appropriately identified, trained and made aware of the constraints imposed by Legislative Decree no. 196/2003.
 
3) Nature of disclosure: the disclosure of personal details is optional, however it may be necessary in order to achieve certain purposes (opening of contractual and commercial relationships), in which case the failure to disclose mandatory data will prevent such purposes from being achieved.
 
4) Disclosure to third parties: the personal details will not be disclosed or disseminated to third parties.
 
5) Privacy Manager: the Privacy Manager is Caffè Haiti Roma S.r.L. of Rome – Via Ardeatina 1010, represented by its legal representative for the time being.
 
6) Rights of the person concerned: you are entitled to exercise the rights provided for by art. 7 of Legislative Decree no. 196/2003, the text of which is entirely referred to herein.
 
Art. 7 (Right of access to personal details and other rights)
1. The person concerned is entitled to be confirmed about the existence or not of information about him/her, even if not yet recorded, and their disclosure in intelligible form
2. The person concerned is entitled to be advised of:  
a. the source of information;    
b. the purposes and form of their processing;    
c. the principle applied in case of automated processing;    
d. the ID of the Privacy Manager and its designated representative and persons in charge under article 5, 2;    
e. the entities or categories of entities to which the information may be disclosed or which may learn them as designated representatives in the State territory, managers or contractors.
3. The person concerned has the right to obtain:    
a. update, correction or, where of interest, supplement of information;    
b. removal, anonymisation or barring of the information processed in breach of the law, including those that do not require to be kept for the purposes they were originally gathered or subsequently processed;    
c. certification that the operations in items a) and b) have been brought to the knowledge, including regarding their content, of the entities to which such information was disclosed, except where this is impossible or implies an evidently disproportionate effort compared to the right being protected.
4. The person concerned has the right to oppose, in whole or in part, to:    
a. the processing of his/her personal details, even for reasons pertaining to the purpose they were disclosed for, for legitimate reasons;    
b. the processing of his/her personal details for the purpose of advertising mailing or direct selling, market surveys or commercial communications.
